1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Client," "you," or "your"), and Prime Web Creations ("Company," "we," "us," or "our"), concerning your access to and use of our website (primewebcreations.net), as well as any other media form, communication channel, or services related or connected thereto.

All projects are governed by custom proposals or statements of work outlining specific deliverables, timelines, milestones, and investment pricing.

4. Client Responsibilities & Materials

To ensure timely and successful delivery of website and branding projects, Clients agree to:

• Provide accurate, truthful, and complete business information;
• Supply necessary brand assets, logos, high-resolution imagery, and copy in a timely manner;
• Warrant that all materials provided do not infringe upon any third-party copyrights, trademarks, or intellectual property;
• Review deliverables and provide consolidated feedback within agreed timelines.

5. Intellectual Property Rights & Ownership

Upon receipt of full and final payment for completed projects, Prime Web Creations transfers ownership of the custom website design, code, graphics, and finished deliverables created specifically for the Client.

Prime Web Creations retains the right to display the completed website and design deliverables in our portfolio, case studies, and promotional materials as an example of work completed. Third-party open-source software, fonts, and frameworks remain subject to their respective open-source or commercial licenses.

6. Payment Terms & Invoicing

Payment terms, milestones, and deposit schedules are established in the project proposal. Unless otherwise specified in writing:

• An initial deposit is required before project kickoff and development begin;
• Final milestone balance is due prior to final domain launch and asset transfer;
• All fees are quoted in U.S. Dollars (USD) and payments must be made via authorized electronic payment methods.

7. Warranties & Disclaimers

We build websites adhering to modern performance, responsive design, and search engine accessibility standards. However, our website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Prime Web Creations does not guarantee specific revenue outcomes, third-party search engine algorithms, or third-party platform uptime (e.g., domain registrars, hosting providers, or external advertising networks).

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Prime Web Creations, its owners, directors, employees, or contractors be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits or loss of data, arising from your use of the website or our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Indemnification
